# Terms and conditions

General terms and conditions for using the helferplanung.app platform, including how WhatsApp credits are billed.

## 1. Scope

These terms and conditions govern the use of the “Helferplanung.app” platform by registered users (hereinafter “Customer”).

## 2. Description of services

Helferplanung.app is a software-as-a-service (SaaS) platform for organising and planning helper shifts at events.

The Provider makes the platform available to the Customer in its current version at any given time.

The platform sends notifications to helpers (e.g. registration confirmations and reminders) by email. Organisations with an appropriate subscription can also offer WhatsApp as a notification channel; whether a helper receives WhatsApp messages is decided solely by the helper through their choice of channel. If WhatsApp is not available in an individual case (e.g. credit balance used up, channel disabled or delivery error), the message is sent by email; there is no entitlement to delivery by WhatsApp.

### WhatsApp credits

Sending WhatsApp notifications is billed in credits. The number of credits used per notification depends on the destination country of the recipient’s number; the applicable rates are shown in the application and on the [pricing page](https://helferplanung.app/en/pricing).

Paid subscriptions include a monthly credit allowance. It is granted anew at the start of each billing period; unused allowance credits expire at the end of the period and are not carried over to the next period.

In addition, one-off credit packs can be purchased. Pack credits do not expire and are kept across billing periods. The allowance credits included in the subscription are always used first, then pack credits.

Credits are not a balance with monetary value; payout, refund or transfer to other organisations is excluded. All credits expire when the contract ends.

Organisations can optionally enable automatic top-up (auto top-up). When the balance falls below a threshold, a credit pack is purchased using the stored payment method, limited by a monthly spending cap set by the organisation itself. Automatic top-up can be disabled at any time.

## 3. Registration and user account

Registration is required to use the platform.

The Customer undertakes:

- to provide correct and complete information
- to keep their login details confidential

The Customer is responsible for all activities carried out via their account.

## 4. Use of the platform

The Customer undertakes:

- to use the platform only within the scope of applicable laws
- not to process any unlawful content
- not to collect any personal data without a legal basis

In particular, it is prohibited to process **sensitive personal data** (e.g. health data) without an appropriate legal basis.

## 5. Data processing on behalf of the Customer

Insofar as the Customer processes personal data via the platform, the Customer acts as controller and the Provider as processor.

Processing takes place in accordance with the [data processing agreement (DPA)](https://helferplanung.app/en/data-processing-agreement), which forms part of this agreement.

## 6. Availability

The Provider endeavours to ensure that the platform is available with as few interruptions as possible.

There is no entitlement to availability at all times and free of errors.

## 7. Liability

The Provider is only liable for damage caused by intentional or grossly negligent conduct.

Liability for indirect damage, consequential damage or loss of profit is excluded to the extent permitted by law.

## 8. Data protection

Personal data is processed in accordance with the [privacy policy](https://helferplanung.app/en/privacy).

## 9. Term and termination

The contract is concluded for an indefinite period.

The Customer can delete their account at any time.

Access to the platform ends when the contract ends.

## 10. Changes

The Provider reserves the right to amend these terms and conditions as required.

## 11. Applicable law

Swiss law applies.

The place of jurisdiction is the Provider’s registered office, to the extent permitted by law.
